Which zoning plan applies to a plot?
Every plot in Flanders has a zoning designation. If it lies within a spatial implementation plan (RUP), that plan takes precedence; otherwise an older special development plan (BPA) or general development plan (APA) applies, and where none of those plans exists, the regional zoning plan (gewestplan). A RUP also repeals the provisions of an older regulation that conflict with it (art. 2.3.3 of the Flemish Spatial Planning Code, VCRO).
The plans, from specific to general
- RUP: a spatial implementation plan drawn up by the region, the province or the municipality, with provisions for each zone (land use and building).
- BPA: a special development plan, the older municipal plan for a neighbourhood.
- APA: a general development plan for an entire municipality.
- Gewestplan: the regional zoning plan for the whole of Flanders, dating from the 1970s and 1980s.
What the Perceelscan does with them
It looks up the plan that applies at the address point, with the zone. A plan that is still in preparation is listed separately in the report: it does not apply yet, but it may change the rules.
